GENERAL TERMS AND CONDITIONS OF THE CINCO JOTAS CLUB LOYALTY PROGRAM
1.- Purpose
This document governs the general terms and conditions for joining, operating, and enjoying the CINCO JOTAS CLUB loyalty program, aimed at end-consumer customers of products purchased through the CINCO JOTAS online store (https://www.cincojotas.com/), marketed by GRUPO OSBORNE, S.A.U. (hereinafter OSBORNE).
The program is intended to thank and reward our customers' trust and loyalty through spending accumulation and access to exclusive benefits, discounts, and promotions on CINCO JOTAS brand products.
2.- Scope of Application
These conditions apply to all individuals of legal age who voluntarily join the CINCO JOTAS CLUB by completing the registration form and expressly accepting these terms. The program is valid only for purchases made through the CINCO JOTAS online store within the territory of the European Union.
3.- Membership and Program Operation
Joining the CINCO JOTAS CLUB is free and voluntary. To become a member, the customer must complete the registration form, providing the required personal data and accepting these conditions.
Each account must be associated with a single email address to ensure proper tracking of accumulated spending and associated benefits.
From the moment of registration, the customer automatically enters the Silver Level, enjoying a 10% discount in the CINCO JOTAS online store and priority access to special offers throughout the year.
4.- Spending Accumulation and Validity
Each purchase made in the CINCO JOTAS online store will result in the accumulation of the corresponding amount in the loyalty program account, at a rate of €1 spent = €1 accumulated. The accumulated amount is valid for 12 months from the date of purchase. After this period, the accumulated amount from that purchase will expire and no longer count toward membership level calculation. Customers can check their accumulated amount in their CINCO JOTAS CLUB profile or via the newsletter sent periodically.
5.- Membership Levels and Benefits
The CINCO JOTAS CLUB has two membership levels:
- Silver Level: From registration, the customer enjoys a 10% discount in the CINCO JOTAS online store and priority access to additional exclusive promotions throughout the year.
- Gold Level: Automatically granted upon reaching €1,000 of accumulated spending in the last 12 months. The customer will enjoy the following benefits:
- 15% discount in the CINCO JOTAS online store.
- Priority access to new releases and special promotions.
To maintain Gold Level status, the accumulated amount must be equal to or greater than €1,000 in the last 12 months. Otherwise, the customer will revert to Silver Level and may regain Gold Level status upon surpassing the threshold again.
CINCO JOTAS CLUB member benefits cannot be exchanged for cash.
6.- Communications
CINCO JOTAS CLUB members will receive all communications related to the program at the email address provided during registration and/or through announcements or communications on the CINCO JOTAS website.
7.- Terms of Use and Cancellation
The CINCO JOTAS CLUB is completely free, with no fees or additional charges. Each account must be associated with a single email address.
Fraudulent use, improper benefit acquisition, or violation of the terms may result in automatic removal from the program and loss of associated benefits.
Customers may request cancellation of their CINCO JOTAS CLUB membership and account deletion at any time by sending an email to sac_web@osborne.es.
8.- Personal Data Protection
The information and personal data provided by the user as a member of the CINCO JOTAS CLUB will be processed in accordance with the Privacy Policy and Cookies Policy. By using this loyalty program, the user expressly consents to the processing of such information and data and declares that all information or data provided is truthful and accurate.
9.- Program Modification and Cancellation
OSBORNE reserves the right to modify, suspend, or cancel the loyalty program, in whole or in part, at any time, notifying members through the communication channels indicated in section 6.
In the event of cancellation of the CINCO JOTAS CLUB, members will have a period of thirty days to enjoy their benefits until the final termination of the program, at which point the benefits will lose their validity.
In cases of force majeure, the CINCO JOTAS CLUB may be suspended or canceled without prior notice to members.
10.- Liability
The company shall not be liable for damages arising from misuse of the program, inability to enjoy benefits due to circumstances beyond its control, or suspension or cancellation of the program under the terms set forth in these conditions.
11.- Intellectual and Industrial Property
OSBORNE is the owner of this website and the CINCO JOTAS CLUB. Unless expressly stated otherwise, OSBORNE holds all intellectual and industrial property rights to the contents of this website, including but not limited to databases, trademarks, logos, images, graphics, texts, photographs, distinctive signs, HTML code, audio, video, musical creations, sounds, images, and software, and generally all creations expressed by any means or medium, tangible or intangible, currently known or invented in the future, protected by national and international intellectual and industrial property laws.
Therefore, its content may not be manipulated (modified, copied, altered, reproduced, transmitted, adapted, translated, or otherwise manipulated) by the user or third parties, in whole or in part, without OSBORNE’s express authorization.
The provision of services and publication of content through the website does not imply, under any circumstances, the transfer, waiver, or transmission, in whole or in part, of the ownership of the corresponding intellectual and industrial property rights.
No part of this website may be reproduced, distributed, transmitted, copied, publicly communicated, transformed, in whole or in part, by any manual, electronic, or mechanical system (including photocopying, recording, or any information storage and retrieval system) through any medium currently known or invented in the future.
OSBORNE does not grant any license or authorization of use of any kind over its intellectual and industrial property rights or any other property or right related to the website.
If any culpable or negligent act or omission directly or indirectly attributable to the user of the website results in the infringement of OSBORNE’s intellectual and industrial property rights, whether or not it benefits the user, and causes OSBORNE damages, losses, joint liabilities, expenses of any kind, penalties, coercive measures, fines, and other amounts arising from any claim, demand, action, lawsuit, or proceeding, whether civil, criminal, or administrative, OSBORNE shall have the right to take legal action against the user and claim any compensatory amounts, including but not limited to moral and image damages, actual damages and lost profits, advertising or other costs incurred for reparation, penalties or judgments, interest for late payment, financing costs, legal costs, and defense expenses in any proceeding in which it may be sued for the aforementioned causes, without prejudice to any other legal actions available.
12.- Applicable Law and Jurisdiction
These conditions shall be governed in all respects by Spanish law.
Without prejudice to any rights the user may have as a consumer, any dispute arising from the loyalty program shall be submitted, with express waiver of any other jurisdiction, to the exclusive jurisdiction of the Courts of El Puerto de Santa María (Cádiz).
